These Terms and Conditions govern the access and use of the hdathenashop.com Website and Online Store.
Hdathenashop.com is the "Website" and the "Online Store" of exhibition and distribution of products via the Internet, which is managed and maintained by the Greek company under the name "HDKA ATHENA MOTORS LTD", based in Athens (Piraeus Ave. No. 187), in Greece (No. GEMI 124059601000, Tax Identification Number: 800466557 / Tax Office of ATHENS) (hereinafter referred to as "Harley Davidson Athena", or "Seller", or "Company"). Harley Davidson Athena manages and maintains the online store "hdathenashop.com" (hereinafter "the online store of Harley Davidson Athena").
Any natural person who visits the pages of the site or makes use of the services for the sake of brevity is hereby referred to as "User / Customer" or "Visitor".

The Company undertakes that the information provided by this Website is complete, true, valid and up to date, whether it relates to our identity or to the products / services provided by our online store. Hdathenashop.com has taken all the necessary technical and other means in order to be immediately informed of the available quantity and sizes of our products, however it maintains an explicit reservation regarding the validity of the quantities and sizes of products available in the online store, as the information may be updated within a certain period of time from the moment of their modification.

Your registration as a Member of hdathenashop.com is at your sole discretion and is not a mandatory procedure for purchasing from our online store or for providing our other services, including your simple browsing of our Website.
The Company undertakes to protect the personal data of the Users / Customers of the website hdathenashop.com and all its websites and to observe the relevant provisions on personal data protection (Law 2472/1997 and 3471/2006 for the protection of the individual from the processing of personal data) as applicable.

In any case, hdathenashop.com is not responsible if the newsletters are not delivered to their destination, although it makes every effort with ISP’s (Internet Service Providers) to deliver them. Newsletters can end up in Junk / Spam folders, so please check regularly that they are not stored there. In case you wish to no longer receive informative newsletters or you wish to unsubscribe altogether from the news submission system of hdathenashop.com, you can inform us using the contact form of the Website or through the corresponding link "To unsubscribe from the list click here »Which appears in the informative emails you receive. 3. ORDER METHODS / PROCESSES
3.1 Online Order – Online Shopping
3.1.1 Completion / Confirmation
To complete the purchase of one or more products from hdathenashop.com, use the categories CLOTHES, SHOES, BAGS, ACCESSORIES, located in the main menu of our page and navigate to find what you are looking for.
Check the products in the shopping cart by clicking on the "SHOPPING CART" link, which is located at the top of the Website. You can use Delete to remove products from your cart before completing your order. Clicking "FINISH ORDER" will lead you to the order form, which appears before the completion of the Purchase Agreement.
The order form will contain brief information about the basic characteristics of each product of the order, its price (including all applicable fees and taxes) and shipping costs. The prices listed on the products include VAT. and are considered final. Hdathenashop.com reserves the right to change prices without prior notice to customers. In any case, however, the customer at the time of receipt of the product ordered will pay the price, which was listed at the time of order. You can find detailed information about the shipping costs of our products in Section 6.
Click on "COMPLETE ORDER" to complete your purchase. You can pay in one of the ways listed in Section 7.
Before submitting the order form you will be informed that sending the form to the Seller means that you agree to pay the stated amount of the order. You will also be prompted to identify and correct possible errors in the information you entered.
By submitting your order according to the above, you will automatically receive a message in the email address that you have provided at the end of the order, which will notify you that your order has been received.
The Purchase Agreement is considered completed when the Seller receives your order form electronically and verifies the order details correctly. After this verification, hdathenashop.com will ship your order. From this point on, you do not need to do anything else until you receive your products.
The registration of an order does not imply an automatic freezing of the stock. In cases of low inventory, hdathenashop.com reserves the right not to execute any order or part of it, if availability in relation to demand proves insufficient. In this case an update will be provided. The final confirmation of availability is made during the processing of the order and the collection of the products. If the products presented on hdathenashop.com during your last access to the Website or when the order form is sent are no longer available or are no longer sold, the Seller will inform you of the unavailability of the ordered products within thirty (30) days from the next day of sending the order form.
The order form will be registered in our database for the required time of execution of your order and in accordance with the law. You can access your order form by clicking on the Orders subsection of the "Account" section.
The Seller will not place orders when there are insufficient solvency guarantees, when orders are incomplete or incorrect or the products are no longer available. In the above cases, we will inform you via e-mail that the Contract has not been concluded and that the Seller did not execute your purchase order specifying the relevant reasons.
If the order form has been sent and the price has been paid for products that are no longer available, the Seller will refund the amount paid for these products without undue delay and the Purchase Agreement will be considered terminated for both parties.

By submitting the order form to the Seller, you unconditionally agree and undertake to comply with the provisions of these Terms & Conditions of your contract with the Company. If you do not agree with certain provisions of these Terms & Conditions, please do not submit the order form for the purchase of products from hdathenashop.com.
We remind you that the product you buy is intended exclusively for the country in which you place the order. Therefore, if you decide to import the product into another country, you remain responsible for importing it. You must comply with the regulations and restrictions for the export of the product from the country of purchase as well as for the import to the country to which you are going to transport it. The Company disclaims any responsibility for such action.
3.1.3 Online Order – Tracking
You can at any time monitor the status of your order through the Orders subsection of the "Account" section.
If your order is in shipment and has been delivered to the courier company, you have the opportunity to be informed about the location of your parcel, through the bill of tracking number, which will be listed on each of your orders.
3.2 Order via Telephone

You can talk to our specialized staff, find out more about the product you are interested in and order it by giving the product code listed in the online store.
Attention: telephone orders with a payment method that requires you to login to the services of banking or other similar institutions can not be made by phone.

3.3 In-Store Orders
You can visit the Harley Davidson Athena store. The specialized staff of the store will help you choose the most suitable product for you and will answer to any questions you may have.
4. CANCELLATION / MODIFICATION OF YOUR ORDER
Cancellation / Modification of an electronic or telephone order can be done by the User / Customer in the following cases:
4.1 Before Completing the Order
Before submitting the order form according to the above (see Section 3.1.1) you are technically able to return to a previous stage of the Order and Remove / Modify the quantities of products in your cart. You can remove the products you do not want to order by clicking the "remove" button and add the new products you want.
4.2 After the Completion of the Order and Before the Shipment of the Products
4.2.1 Modification of the Order Before the Shipment of the Products
Modification of your order after the completion of the submission of the order form can be done by contacting the Customer Service Department or by phone at (+30) 210 3410850 daily on working days and hours, or via email at email@example.com.
4.2.2 Order Cancellation Before Sending the Products
If the submission of the order form has been completed, but the products have not been sent yet, you can cancel your order by sending an email to the email address firstname.lastname@example.org or by phone at (+30) 210 3410850 every working day and hours.
4.2.3 Upon Receipt of the Products - Right of Withdrawal (see Section 9)
18.104.22.168 You have the right to cancel your order after its completion (and upon receipt of the products) in case the delivery of the ordered products is delayed. The provisions of Section 5.2 below apply to the cancellation of your order.
22.214.171.124 Any refusal to receive your products upon delivery by the Courier Company is equivalent to a withdrawal, a right for the practice of which you retain and to which the provisions of Section 9 below apply. In case a customer refuses to receive products more than 3 times, hdathenashop.com reserves the right to charge the customer the shipping of all shipments or to refuse to send the products.
Upon return of the products to hdathenashop.com, the order is canceled by exercising the Right of Withdrawal in accordance with the provisions of Section 9.2 below.
In accordance with all the above, all orders returned to the Seller either due to a request of cancellation of the User / Customer, or due to a refusal to receive, are canceled after the products arrive to the Seller.
5. PRODUCTS DELIVERY
5.1 Order Validity
Orders remain valid and are available for delivery up to fifteen (15) calendar days from their registration. For Receipt from the Store, the orders remain valid and available for delivery up to five (5) calendar days from their registration.
In case the delivery of the order is not possible (indicatively mentioned: inability to communicate, non-attendance for receipt of the product, non-availability of the product requested with the order) and after the expiration of this deadline, the order is canceled.
Special Cases of Shipments and/or Orders
In special cases of orders of large volume or weight, the shipment is made by means of transport of the absolute choice of the Company, while some deliveries are possible only in large urban areas. The Company reserves the right not to accept specific orders and to reject specific sales, informing in a timely manner and returning the full price of the canceled order.
For certain product categories, such as products that come on order, or are of very high value, or outside the normal flow of hdathenashop.com, a deposit may be required before the order is placed.
5.2 Method and Time of Delivery
The online store hdathenashop.com delivers its products throughout Greece and Cyprus. Shipments are made daily except Saturday, Sunday, at delivery times of the cooperating Courier companies. Delivery is also possible on Saturday (if requested in the comments of the order). In case of delivery on Saturday, you agree that the delivery of the products will be charged in accordance with the provisions of Section 6 below.
From the above days and hours of delivery are excluded the cases for which the transport company Courier can not cope due to its own fault.
Without prejudice to what is expressly stated in these Terms & Conditions, any order that is completed by 1:00 p.m. from Monday to Friday, is delivered within 1-3 working days within Greece and within 2-6 working days within Cyprus.
In case your order is completed by submitting it to us after 1:00 pm, the delivery time increases by one working day, according to the above.
The above deadlines do not apply during periods of extreme weather conditions or general strikes and holidays and in any case of force majeure, which may affect transport and delivery times. In this case hdathenashop.com cooperates with specific courier and transport companies.
In case you want to send your order with a transport company of your choice with which hdathenashop.com does not cooperate, then the shipping costs are borne by you regardless of the value of the order and place / time of delivery. In this case hdathenashop.com bears no responsibility for any delays in the delivery of your products.
Orders placed from the Website of a country other than the country at the shipping address or shipping address is in a country where the Seller cannot ship products, will be canceled automatically.
Shipping & Sending your Orders means full acceptance of the Terms & Conditions
5.3 Delayed Delivery
Our Company makes every effort for the timely and proper delivery of your orders in accordance with the above mentioned in Sections 5.1 and 5.2. However, Seller reserves the right to delay delivery of products.
Delays in product delivery may be due to a variety of events, including either force majeure, such as extreme weather conditions, strikes, or any other event outside our sphere of influence or control, product unavailability due to stock depletion, or delay in shipping the product by the manufacturer / supplier.
In any case of delay in the delivery of the products we will contact you to inform you and ask if you want to deliver the order without the product that is delayed or not available, or to suggest you an alternative, or to inform you about delivery time of the product that is not immediately available. In case you are not satisfied with our offer, you have the right to cancel part of the order or the entire order. In this case the Company will refund you the corresponding amount of money you may have paid.

For orders €200 or over, shipping costs are FREE, otherwise shipping costs are €7.00
In case the order delivery is requested on a Saturday, the order will be charged with extra shipping costs of €3.00
The first return as well as the first replacement is FREE (for products without discounts) for shipments within Greece using the cooperating Courier company 'General Post'.
Returns or Replacement Costs on products with offer, discount or within discount periods, are borne exclusively by the customer.
The listes prices include VAT.
COLLECTION FROM THE STORE
In case you choose to pick up your order from our physical store during your purchase, you must first receive a phone call or confirmation e-mail that the products are in the store and ready for pick up.
For orders of €200 and over, shipping costs are FREE, otherwise shipping costs are €20.00
It is not possible to deliver an order on Saturday.
Returns and replacements are at the customer's expense.
The listed prices include VAT.
In case a customer refuses to receive products in accordance with the right of withdrawal, more than 3 times, hdathenashop.com reserves the right to charge the customer the shipping of all shipments or to refuse to send the products.
Customers, who in their history have shipments that refused to receive or did not respond to our written or telephone (or the courier's 'General Post') information update and thus were returned to us, with the indication (NOT INTERESTED - DISCLAIMER) will receive after of the total amount of their new order exclusively through PayPal, credit, debit and prepaid cards or deposit in a bank account.
Payment for the products and related shipping and delivery costs must be made using one of the payment methods listed on the order form. In no case will the User / Customer be charged with additional charges by the Seller based on the payment method he chooses, in addition to those listed in the order.
7.1 Cash on Delivery - Payment Upon Delivery of the Order
The User / Customer who chooses the CoD method pays in cash the courier company, which acts under order of hdathenashop.com, at the time of delivery of the order to the place indicated by the customer or upon receipt of the product by Courier company store.
Maximum Cash on Delivery Value is €2.000
7.2 Credit Card Payment
7.2.1 Collaborating Cards - Process
All credit, debit and prepaid Visa, Mastercard, Maestro, Diners and American Express cards are accepted at hdathenashop.com.
Delivery of orders where payment has been made by credit card, is made only to the credit card holder, with the presentation of the card and the police ID. Credit card payment orders are not delivered to a third party.
The listed prices include the legal Taxes.
Until the full payment of the price, the goods remain the property of the seller company.
7.2.2 Credit / Debit Card Information
Credit card information are requested upon completion of your orders if you choose the relevant payment method and relate exclusively to their electronic transmission through a secure environment to the banking institution for the completion of your payment only. The Company does not hold any credit card information in its database.
The implementation of the cardholder certification service may require the transfer of their card details to a third party provider, in cooperation with the bank that implements the completion of the card payment process. This information is sent via an encrypted protocol without any third party having any access to it.
This information will not be used by the Seller except for the execution of the procedure related to the purchase or issuance of refund orders in case of returned products, in compliance with the practice of the right of the User / Customer to return the products or for reporting cases of fraud to the police. The purchase price of the products and the relevant shipping and delivery costs, as mentioned in the order form, will be charged to the current account of the User / Customer, when the purchased products are sent.
7.2.3 Shopping Security

All information, which is related to the personal data of the Users / Customers, is ensured as confidential in compliance with the current legislation for the protection of personal data. Hdathenashop.com has adopted the 3D-Secure protocol in order to offer users increased protection against unauthorized use of their card during the transaction process. Cartoon-consumers of banks that support the 3D-Secure protocol have the opportunity to integrate their Visa, MasterCard and American Express cards in the Verified by Visa, SecureCode or SafeKey programs respectively, so that cardholders can choose a security code for each of their cards that only they will know. If you do not have a PayPal account, you can create one from the PayPal login page by clicking here. For information about PayPal you should visit PayPal's website. Orders with PayPal payment method are subject to additional checks by our company and may be rejected, you may be asked for another payment method or there may be delays in sending them. You may also be asked to provide additional identification information.
PayPal payment is only available for online orders from hdathenashop.com.

You can choose Deposit in a Bank Account as a method of payment and deposit the price of your order in the bank account of the Company, using the order code that will be given to you immediately after the registration of your order. The order code is also included in the Order Confirmation email that you will receive immediately after the Completion of your Order. Payment can be made through your e-banking or at a Bank branch, using the order code as Reason / Description to Beneficiary.
In case you use your e-banking, you must enter the order code in the field (Reason / Description to Beneficiary).
In all cases the money that should reach the Company's account should be EXACTLY the amount listed at the end of your order CLEAR, without charges or reservations.
Specifically and in more detail, in the case of e-banking when you are asked to specify who is charged with the costs, (Sender / Principal, recipient or both) you should choose (Sender / Principal).
Your order will be completed by shipment, once the deposit appears in the Company's account. This can take up to 2 business days, depending on the bank process. If you do not make the deposit within 3 working days, the order will be automatically canceled.
Please, upon completion of the transaction, send a copy of the payment order by email to firstname.lastname@example.org for the immediate processing of your order.
7.5 Credit Control
All orders are subject to additional credit checks by the company, which reserves the right without undue reason to ask you at its discretion to either provide additional documents that will identify your details, or to change from the chosen method of payment to a different one, or to completely reject your order and not accept it.

Pricing & Taxation Issues
In all the above payment methods the option of issuing a retail receipt or invoice is available.
Invoice is issued to companies and freelancers, after and if they fill in the following information during their order: Company Name, Activity, VAT number, Tax Office, Mobile and Landline Phone.
Our prices include all legal taxes.
8.1 Price Guarantee
Please check the prices of the products prior to sending the corresponding order form.
8.2 Product Warranty

9.1 Requirements & Conditions for practicing the right of withdrawal

If, on the other hand, you choose to send another type of Withdrawal Statement, the responsibility for the correct and timely exercise of the right of withdrawal rests solely with you.
The Right of Withdrawal is considered valid if - in addition to compliance with the terms and procedures set out in the Consumer Protection Code and described in Paragraphs 9.1 and 9.2 above - the following conditions are met in full:
a. the Return Form sent online through the Website hdathenashop.com or other express statement of the decision to withdraw from the Contract must have been completed correctly and sent to the Seller within fourteen (14) calendar days of the physical receipt of the purchased goods or possession of the last good of the order.
b. the products must not have been used, worn or washed. Returns are accepted if the product has not been used and the protectors have not been removed. 9.3 Consumer Obligations upon Withdrawal
In order to comply with the withdrawal deadline, you must send us your statement on the exercise of your Withdrawal Right before the withdrawal deadline expires in accordance with the provisions hereof. It is expressly agreed that your notice of exercise of the Right of Withdrawal shall be deemed to have reached us on the next business day following the dispatch of the Withdrawal Statement to us in accordance with the provisions herein.
In case of practice of the Right of Withdrawal in accordance with the above, you must return to us (at the address listed here) the product from the purchase of which you withdraw immediately - unless we have agreed to receive it from you in case of withdrawal, without unjustified delay and in any case within fourteen (14) calendar days from the day on which you notified us of your decision to withdraw from the Contract in accordance with the provisions hereof and Article 11 of the Consumer Protection Code. 9.5 Refunds - Procedures and Time Frames

If these conditions are met, you will be sent an e-mail confirming the acceptance of the returned products and the amount of their purchase will be refunded. Refunds will be made as soon as possible, without undue delay and in any case regardless of the payment method used, within 14 days from the date on which the Seller was informed of the User / Customer decision to withdraw from the Sales Agreement in accordance with the above defined and without prejudice to the provisions of Paragraph 9.5.
